Legal Policy & Terms of Carriage (V3.0)

1. Cancellation & Failed Collection Policy

Reliability is the cornerstone of our "1 Van. 1 Bike." premium service. Our refund policy is strictly enforced based on the notice provided:

2. Vehicle Condition Warranty

The Customer warrants that the motorcycle is in "Rolling Condition" (tires inflated, steering unlocked, rolling freely).

Failure to load the vehicle due to seized brakes, locked steering, or flat tires—which prevents safe loading into the EV Van—will result in an immediate cancellation of the slot and the application of the £95.00 Call-out Fee.

3. Joint Liability & Default Penalties

If the "Receiver will pay the balance" option is selected, the Sender (Booking Party) accepts full joint and several liability for the total fare.

4. Statutory Lien & Right of Sale (Torts Act 1977)

Blackline Moto asserts a general and particular lien over all transported assets pursuant to the Torts (Interference with Goods) Act 1977.

If the balance and associated penalties remain unpaid for 15 consecutive days, Blackline Moto will execute its statutory right to sell the goods to recover costs. Proceeds will be applied in the following order:

  1. Auction house fees, collection, and legal costs.
  2. Accrued Secure Storage Fees (£100/day).
  3. The 3x Breach of Contract Penalty.
  4. The original transport balance.

Any residual balance will be returned to the Sender. If sale proceeds are insufficient, we reserve the right to pursue the Sender for the deficit.

5. Goods in Transit Insurance

Standard transport includes Goods in Transit cover up to £50,000. Vehicles exceeding this value require a Specialist Logistics Quote to ensure bespoke insurance placement. Failure to declare the true value of the asset voids our liability beyond standard terms.
